Legally Speaking

BuyCycle© is a 100% South African online retail company.  We comply with all the relevant South African consumer legislation, particularly the Electronic Communications and Transactions Act of 2000(ECTA), which means you are covered when doing business with us. 
In terms of Section 44 of the ECTA you have a 7 day cooling off period during which you may return goods to us, purely because you have changed your mind.  You will be liable for the return courier fees, though.  See Exchange/Refund: S44 Cooling off period for conditions.
You may return goods within 7 working days in terms of our Returns Policy.
BuyCycle© guarantees no ‘grey imports’, which means that all products on the BuyCycle© website is covered by the normal warranty that would apply if you bought the same goods in a normal retail shop in South Africa.
In the event that a dispute should arise between BuyCycle© and yourself which needs settling by means of litigation, reading and signing off on these terms and conditions implies your agreement that the High Court of South Africa has jurisdiction to settle the dispute.
All disputes will be settled in accordance with South African Legislature.  

Returns Policy   

BuyCycle© does not mind exchanging or refunding items which you found do not fit, was not what you ordered or was faulty or damaged upon receipt.  As long as the returned items are accompanied by a duly completed returns form.

BuyCycle©, will not held responsible for items that are damaged in transit or not insured before being sent to us.
BuyCycle©, urge customers to do their homework regarding sizing beforehand to prevent goods being shipped to and fro unnecessarily.  Take particular care with the following:

• Frame Sizes: Test ride bicycles beforehand to ensure that you order the correct frame size for your riding comfort.
• Part(s) Compatibility: sizing & specifications are not universal and differs from manufacturer to manufacturer.
• Apparel, Shoes & Helmets: Try fitting on the garment, gloves, shoes or helmet beforehand to ensure a perfect fit.

Exchange/Refund:  S44 Cooling off period

In terms of Section 44 you may cancel the transaction within 7 days of receipt of the goods. 
You need to inform us in writing here of your intention to cancel the transaction before expiry of the 7 day period.  Make sure that we receive such notification of cancellation within 7 days of you receiving the ordered goods or you might not enjoy the protection offered under Section 44.

A handling fee of 10% of the costs of the item(s) returned.

Please note the following:

• Merchandise must be returned within 7 working days of receipt
• Merchandise must not have been fitted, used or damaged
• Merchandise must be in the original packaging
• Merchandise must be accompanied by a copy of the original BuyCycle Invoice.
• You will be expected to carry the courier cost for the return
• BuyCycle© will give you a full refund once the goods have been received back in good order

Exchange/Refund:  New items

Should you find the ordered item not to your liking through no fault of BuyCycle©, you are welcome to return it to us for a refund or an exchange.

However, a handling fee of 10% of the total order, including the incurred shipping charges will be invoiced to you and is payable by means of credit card or electronic transfer. Once Proof of Payment is received, we'll process exchange/refund the additional original invoiced amount.

Important:

• You will be expected to pay all shipping costs (please remember to Insure item when shipping)
• You will be expected to pay an administration fee of 10% of the total invoiced order.

Exchange/Refund:  BuyCycle©’s error

If you feel BuyCycle© has made a mistake with your order and we sent you something which is not what appears on your invoice, BuyCycle© will happily exchange these items for you.  BuyCycle© will make the necessary arrangements to pick up the item(s) from the original delivery address and return them at BuyCycle© cost. Please contact us at martin@buycycle.co.za to make the necessary arrangements.
Important:

• Merchandise must not have been fitted, used or damaged
• Merchandise must be accompanied by a returns form
• Arrange with BuyCycle© to send a courier to pick up the erroneous order at BuyCycle©’s cost.

Warranty

Please check that all goods are in full working order upon receipt. 

• Products sold through the BuyCycle.co.za are serviced and supported exclusively by their manufacturers (via local importers) in accordance with the terms and conditions packaged with the product(s). The respective manufacturers limited warranties therefore apply. Full details of the applicable manufacturers warranty cover can also be viewed on their websites. Please note that warranties only cover manufacturing faults and defects and do not cover damage caused by normal wear and tear or abuse. 

• If you feel that your product has developed a fault and should be exchanged under warranty, please contact BuyCycle.co.za at info@buycycle.co.za to determine whether this is indeed a warranty issue (emailing pictures would assist us).  This is to eliminate unnecessary transport costs.  We will contact the supplier and do our best to sort out the problem.
• Warranty only applicable on products owned by the first owner

• You need to arrange the return of the goods by means of door to door courier.

B) "Sale" Items: There are no guarantees or warranties from either the manufacturer or BuyCycle.co.za for any item offered as "Sale item". These items are generally "end of line" items & are sold at clearance pricing.

Cancellation of orders
 

• The cancellation of confirmed orders should be discussed with, and agreement obtained in writing from a director of the BuyCycle.co.za within 24 hours from placing the Order.
• Confirmed orders will be subject to a minimum cancellation fee of 10% of the total order plus any incurred shipping or handling charges.

Delivery/Shipping

• Whilst every effort will be made to ensure that your order is ready for collection/delivery as soon as possible, please allow anything from 3 & up to 10 working days (after receiving a "Processed" email), for delivery.
• BuyCycle.co.za rely on other local importers, shipping agencies and delivery agencies for the distribution of our products and cannot be held responsible for late delivery for reasons beyond our control.
• BuyCycle.co.za ships from various warehouses located around SA. So you may receive numerous deliveries, per Order (depending on the items ordered).
• We cannot deliver to PO Box numbers so please ensure that your address details are correct (fiscal day time, 9am-5pm, Mon-Fri address).
• You will be provided with a tracking number upon dispatch of your order (when receiving a "Shipped" email) to enable you to track your parcel(s).

BuyCycle does not ship outside th RSA borders. You are more than welcome too contact us martin@buycycle.co.za & arrange your own courier for shipping across borders.

Insurance cover during shipping

• At check-out, you may elect to take out additional delivery insurance to cover your parcel during the delivery period at your own cost. 
• The insurance premium is 2% of the total value of your invoice with a minimum premium of R85.
• Should you elect not to take out additional insurance, BuyCycle© cannot be held accountable for any loss or damage to the ordered goods that may occur during shipping to your delivery address.

Pricing, Errors and Omissions Excepted

Every effort is made to ensure the accuracy of information contained in the online store and of all invoices. Discrepancies can arise due to model changes and stock availability. BuyCycle.co.za cannot be held liable for items supplied that are not to the specification described. Prices are also subject to change due to fluctuating exchange rates. All prices include VAT. Prices are updated regularly and may change without prior notice. BuyCycle.co.za reserves the right to change prices without notice from time to time.

Payment

When purchasing goods at BuyCycle© payment can be made by means of electronic transfer or by means of a credit card.  BuyCycle© accepts most major credit cards. 
When paying by means of electronic transfer BuyCycle© will only process your order once confirmation of payment has been received. Please make sure to email the Proof of Payment to accounts@buycycle.co.za Orders will only be "Processed" once we receive the POP.
Payment by means of Credit card is handled by MyGate - an independent and secure payment gateway which ensures absolute security when buying online by means of a credit card.  See Credit Card Security for more information.  

Credit Card Security  

When you make your purchase by means of credit card we will ask you to provide us with your billing address, your card type, credit card number, cardholder’s name, expiry date and CVV2 number (last 3 digits on the back of your card).  You need not worry that these details can be ‘hijacked’ by BuyCycle© personnel.  BuyCycle© uses an independent and secure payment portal called MyGate to ensure safe, secure and swift on-line payment transactions.  Please note that BuyCycle© might have to phone you for additional details in the interest of credit card security.

Privacy Policy

BuyCycle© vows to protect your privacy. 
When registering at BuyCycle©, we will ask you to provide your name, e-mail address, billing address, delivery address and telephone number.  This information is essential for the processing of your order and to keep you posted on the status of your order.  We would like to keep you informed on any specials that we are running at any given time and will also use the contact information provided for that purpose, unless you would prefer otherwise, in which case you may unsubscribe from our mailing list at your convenience. 
You may rest assured that BuyCycle© will NOT divulge any customer information to third parties under any circumstances.

Cookies
Cookies are minute files that are stored on your computer. The BuyCycle© website uses these files to remember the preferences you selected for example what items are in your basket, or which currency you have selected as well as various other settings which are in place to make the use of the website simpler and easier.  Cookies are important for the proper functioning of the BuyCycle© website or any shopping website for that matter.

Stock Availability

BuyCycle© updates stock levels daily.  Should an item become temporarily out of stock, the item will be listed as ‘out of stock’.  In the instance that an item becomes permanently out of stock, the item will be removed from the website entirely.  In the rare event that you should order an item that has become temporarily out of stock without the item displaying as ‘out of stock’, we will contact you and you may elect to either cancel the order or wait until the item is in stock again. You're Order will be placed on "Back Order" status.

Out of Stock Orders

Stock levels are updated daily and it does occasionally happen that we temporarily run out of a particular item, in which case the item will be marked ‘out of stock’.  Should you wish to order an item that is temporarily out of stock, you may add the item to your wish list and we will process the order so long and dispatch it as soon as we have stock again.  Your credit card will only be billed once the item has been dispatched.

Correct Information

BuyCycle© goes to great lengths to ensure that the content, images, descriptions, prices and information on the website is accurate.  We continuously update content using manufacturer’s and supplier’s catalogs and price sheets. We put in a lot of effort to ensure that product descriptions match photographs at all times so that our products are showcased accurately. 

Changes and Amendments

Any changes to our terms and conditions will be posted here and you will at all times be up to speed on the way orders are processed.  You will also know exactly how we use information provided to us by our customers.

Disclaimer of warranties
